Terms of Service

The agreement between you and RigSpot, a DBA of Stow In Storage LLC governing your use of the platform.

PLEASE READ THESE TERMS CAREFULLY. By creating an account or using the RigSpot platform, you agree to these Terms of Service. If you do not agree, do not use RigSpot.

1. Parties & Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and RigSpot, a DBA of Stow In Storage LLC ("RigSpot," "we," "us," or "our").

By clicking "I accept," checking the acceptance box, or otherwise affirmatively accepting these Terms, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accepting on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Platform Description

RigSpot is a two-sided marketplace platform that connects commercial truck drivers and fleet operators ("Drivers") with property owners and operators ("Lot Owners") who offer commercial truck parking spaces. RigSpot provides technology infrastructure, booking management, and payment processing services.

Important: RigSpot is NOT a transportation carrier, freight broker, parking operator, or property manager. RigSpot does not own, operate, manage, or control any parking facilities listed on the platform.

3. User Types & Eligibility

3.1 Drivers

Must be at least 21 years of age. Must hold a valid commercial driver's license (CDL) or be operating under the supervision of a licensed fleet operator.

3.2 Lot Owners

Must be at least 18 years of age. Must own, lease, or have legal authority to offer the parking property listed. Must carry adequate premises liability insurance.

3.3 Fleet Dispatchers / Fleet Administrators

Must be at least 18 years of age. Must be authorized to act on behalf of the fleet company. Accepts these Terms and the Fleet & Dispatcher Terms on behalf of their organization.

3.4 Gate Attendants

Must be at least 18 years of age. Are subject to the Gate Attendant Terms upon assignment by a Lot Owner.

3.5 Community Moderators

Must be at least 18 years of age. Are subject to the Moderator Terms upon earning moderator status.

4. Account Registration & Security

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify RigSpot immediately of any unauthorized use of your account at rigspot@polsia.app.

5. Platform Fee & Payment Terms

5.1 Driver Fees

Drivers pay the exact listed price for parking. RigSpot charges no service fees or markups to drivers.

5.2 Lot Owner Fees

RigSpot charges Lot Owners a 12% platform fee on each completed booking, deducted from the Lot Owner's payout. Lot Owners may alternatively elect a flat monthly subscription plan.

5.3 Payment Processing

All payments are processed through RigSpot's integrated payment infrastructure. By using the platform, you authorize RigSpot to charge payment methods on file for bookings and any applicable fees.

5.4 Refunds & Cancellations

Refund and cancellation policies are governed by the individual lot listing and RigSpot's Cancellation Policy.

6. Prohibited Conduct

You agree NOT to:

  • Use the platform for any unlawful purpose
  • Post false, misleading, or fraudulent listings or reviews
  • Discriminate against any user based on race, color, national origin, religion, sex, sexual orientation, disability, or any other protected characteristic
  • Circumvent RigSpot's payment system to transact directly with other users
  • Use automated tools, bots, or scrapers to access the platform
  • Interfere with or disrupt the platform's infrastructure
  • Share your account credentials with others
  • Impersonate another person or entity

7. Anti-Discrimination Policy

RigSpot has a zero-tolerance policy for discrimination. Lot Owners may not refuse service to, or provide inferior service to, any Driver or other user based on any protected characteristic under federal, state, or local law.

Violations may result in immediate account suspension and permanent ban. Users who experience discrimination may submit a priority report through the platform, which receives a 24-hour SLA for admin review. No automatic restrictions are applied to accused users โ€” our team reviews all evidence before taking action.

8. Intellectual Property

All content, trademarks, logos, and intellectual property on the RigSpot platform are owned by or licensed to RigSpot, a DBA of Stow In Storage LLC. You may not reproduce, distribute, or create derivative works without express written permission from RigSpot.

9. Disclaimers & Limitation of Liability

THE RIGSPOT PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Third-Party Listings

RigSpot does not verify, endorse, or guarantee any parking listing. Users transact at their own risk.

9.3 LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RIGSPOT'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO RIGSPOT IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). RIGSPOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Indemnification

You agree to indemnify, defend, and hold harmless RigSpot, a DBA of Stow In Storage LLC and its parent company, officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the platform.

HOS Compliance Disclaimer: RigSpot provides a parking marketplace, NOT compliance advice. Drivers and dispatchers are solely responsible for compliance with all federal Hours of Service (HOS) regulations (49 C.F.R. Part 395), FMCSA requirements, and any other applicable federal or state regulations governing commercial vehicle operations.
Driving Decisions Disclaimer: All route choices, stop timing, parking decisions, and driving decisions are solely the driver's and dispatcher's responsibility. RigSpot provides information about parking availability and does not direct, advise, or control any aspect of vehicle operation or driver scheduling.
Parking Outcomes Disclaimer: Any damage, theft, vandalism, accidents, or other incidents occurring at a listed parking facility are matters solely between the driver and the lot owner. RigSpot is not a party to such incidents and accepts no liability therefor.

11. Arbitration Agreement & Class Action Waiver

11.1 BINDING ARBITRATION: EXCEPT AS PROVIDED BELOW, ALL DISPUTES ARISING OUT OF OR RELATING TO THESE TERMS OR THE RIGSPOT PLATFORM SHALL BE RESOLVED BY BINDING ARBITRATION UNDER THE FEDERAL ARBITRATION ACT ("FAA"), RATHER THAN IN COURT.
11.2 CLASS ACTION WAIVER: YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
11.3 Opt-Out Right: You have the right to opt out of this Arbitration Agreement within 30 days of first accepting these Terms. To opt out, log in to your account and visit My Agreements โ†’ Arbitration Opt-Out, or send written notice to rigspot@polsia.app. Your opt-out must include your full name and email address.

11.4 Exceptions

The following disputes are excluded from mandatory arbitration and may be brought in court:

  • Small Claims Court: Either party may bring an individual claim in small claims court for disputes within that court's jurisdictional limits.
  • Injunctive Relief: Either party may seek injunctive or other equitable relief in court for violations of intellectual property rights or unauthorized access to the platform.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Georgia and the laws of the United States, without regard to conflict of law principles. For claims not subject to arbitration, you consent to exclusive personal jurisdiction in the state and federal courts located in the State of Georgia.

13. Termination

RigSpot reserves the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason at our sole discretion. Upon termination, all licenses and rights granted to you cease immediately. Data retention provisions survive termination as required by applicable law.

14. Changes to Terms

RigSpot may update these Terms at any time. We will provide advance notice of material changes via email and/or platform notification:

  • Routine updates: 30 days' notice before effective date
  • Security / legal emergency changes: Effective immediately upon notice

Continued use of the platform after the effective date constitutes acceptance of the updated Terms. If you don't accept updated Terms, you may close your account.

15. Electronic Signatures (E-SIGN Act)

By checking the acceptance box or clicking "I Accept," you agree that your electronic signature is the legal equivalent of your handwritten signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. ยง 7001 et seq.) and applicable state electronic signature laws. You consent to conduct business and receive records electronically.

17. Insurance Disclosure

Lot Owners are required to maintain adequate premises liability insurance covering the parking facilities they list on the platform. Lot Owners represent and warrant to RigSpot that such coverage is in effect at all times their lot is active on the platform.

RIGSPOT DOES NOT PROVIDE, ARRANGE, OR GUARANTEE ANY INSURANCE COVERAGE FOR DRIVERS, LOT OWNERS, GATE ATTENDANTS, OR ANY OTHER USER. DRIVERS PARK AT THEIR OWN RISK. RIGSPOT MAKES NO WARRANTY, EXPRESS OR IMPLIED, OF SAFETY, SECURITY, OR FITNESS OF ANY LISTED PARKING FACILITY.

Any claims arising from incidents at parking facilities should be directed to the lot owner and their insurance carrier. RigSpot accepts no liability for property damage, theft, bodily injury, or other incidents occurring at listed facilities.

18. Data Handling Obligations

18.1 Purpose Limitation

Lot Owners and Fleet Dispatchers who access driver or user personal data through the platform may only use that data for the sole purpose of fulfilling reservations and performing platform-related duties. Using RigSpot-provided data for external marketing, unsolicited contact, or any purpose outside the platform is strictly prohibited.

18.2 No Data Export or Sharing

Lot Owners and Dispatchers may not copy, download, export, sell, or share user personal data with third parties under any circumstances. This includes but is not limited to driver contact information, vehicle details, and booking history.

18.3 Data Retention

Lot Owners and Dispatchers have no right to retain driver or user personal data after a reservation is complete and the driver has departed, or after the platform relationship ends. Upon account closure, all data must be treated as deleted from any local copies or records.

18.4 Breach Notification

Lot Owners and Dispatchers must notify RigSpot at rigspot@polsia.app within 24 hours of becoming aware of any unauthorized access, disclosure, or breach of user data.

18.5 Gate Attendant Responsibility

Lot Owners are responsible for ensuring that any Gate Attendants they assign comply with these data handling obligations. Data mishandling by a Gate Attendant is attributable to the Lot Owner.

Violation Severity: Unauthorized use, sharing, or mishandling of user personal data is treated as a severe platform violation, subject to the same escalating enforcement as discrimination reports, up to and including permanent account ban.

19. Driver Data Restrictions

To protect driver privacy, RigSpot restricts what information about drivers is visible to other platform participants:

  • Lot Owner visibility: Business name only; no driver personal contact information.
  • Gate Attendant visibility: Driver first name only, for check-in verification.
  • Other drivers: Driver profiles, names, trucks, and reservations are completely invisible to other drivers.
  • Dispatcher info: Dispatcher identity and contact details are hidden from driver view.
  • Business data: Drivers have no visibility into lot capacity utilization, lot revenue, or booking volume.

No user may use RigSpot-provided data to contact, solicit, or communicate with other users outside the RigSpot platform for any purpose.

20. Force Majeure

RigSpot shall not be liable for any delay, failure, or disruption in platform services resulting from causes beyond our reasonable control, including but not limited to: natural disasters, fires, floods, earthquakes, acts of God, pandemics, epidemics, government actions or regulations, wars, civil disturbances, internet or telecommunications outages, power failures, third-party service failures, or any other event that would reasonably be considered a force majeure event. During such events, RigSpot will use commercially reasonable efforts to restore service as quickly as practicable.

21. Severability

If any provision of these Terms is found by a court of competent jurisdiction or arbitrator to be invalid, illegal, or unenforceable, that provision shall be severed from these Terms to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. The parties agree to replace any invalid or unenforceable provision with a valid provision that achieves the same economic and legal effect to the greatest extent possible.
